Well hold your horsepower, first of all we’ve got some Terms of Use you need to agree to. And it’s important you read and understand them.

To make this as easy as possible, we’ve broken it down into 8 sections.

Shotgun is provided by Direct Line a brand of U K Insurance Limited, also referred to as ‘we’ in these Terms and Conditions.

Please do not register multiple Shotgun accounts as these will be identified and deleted. Registration of multiple accounts is a breach of these Terms of Use.

1 – This bit’s basically about not copying or trying to change Shotgun.

We give you a non-exclusive licence to use Shotgun but you can’t transfer this to anyone else or have more than one account in any three year period.

You agree:

  1. not to copy Shotgun except where it’s part of the normal use of the app, or where it’s necessary for the purpose of back-up or operational security;
  2. not to rent, lease, sub-license, loan, translate, merge, adapt, vary or modify Shotgun;
  3. not to make alterations to, or modifications of, the whole or any part of Shotgun, or allow Shotgun or any part of it to be combined with, or become incorporated in, any other programs;
  4. not to disassemble, decompile, reverse-engineer or create derivative works based on the whole or any part of Shotgun or attempt to do any such thing except to the extent that (by virtue of section 296A of the Copyright, Designs and Patents Act 1988) such actions can’t be prohibited because they are essential for the purpose of achieving inter-operability of Shotgun with another software program, and provided that the information obtained by you during such activities:
  5. is used only for the purpose of achieving inter-operability of Shotgun with another software program;
  6. isn’t unnecessarily disclosed or communicated without our prior written consent to any third party; and
  7. isn’t used to create any software that is substantially similar to Shotgun;
  8. to keep all copies of Shotgun secure and to maintain accurate and up-to-date records of the number and locations of all copies of Shotgun;
  9. to include our copyright notice on all entire and partial copies you make of Shotgun on any medium;
  10. not to make any part of Shotgun available, in any form (including object and source code), to anyone else unless we send a written agreement first;
  11. to comply with all technology control or export laws and regulations that apply to the technology used or supported by Shotgun.

2 – This bit’s about data charges.

For a typical day’s journey of 1 hour each way at 28mph, approximately 4.2MB of data will be used, which is the size of an average digital photo.

Costs will vary by network, but will typically be covered by many contracts. You can stop Shotgun using your data allowance by setting the data transmission to WiFi in the ‘more’ section. We are not liable for any data charges.

If we send you a text message as part of your registration for the app, you must respond to this to activate the app rewards. We are not liable for any charges for you responding to this text.

Shotgun is designed for use in England, Scotland and Wales and Northern Ireland only. If you travel elsewhere you should disable Shotgun. We aren’t liable for any roaming charges incurred as a result of you using Shotgun abroad. Data charges may apply, please contact your mobile service operator for more detail.

3 – This bit tells you who powers Shotgun and how we collect and use data.

Who powers Shotgun?
Shotgun is powered by Direct Line, and Direct Line’s motor insurance is underwritten by U K Insurance limited.
Who’ll use data gathered by Shotgun?

U K Insurance Limited and its partner, Floow Limited will collect your driving data for you to be able to participate in Shotgun and receive rewards, you may also receive service emails. The basis upon which we process your data for Shotgun is consent. For further details, as to how U K Insurance Limited collects, analyses and uses your data can be found here which also applies, where relevant, to Shotgun.

You may ask us to stop using your personal information at any time by withdrawing your consent and we will stop using your personal information for those purposes. The easiest way to do this is to delete the Shotgun App. Shotgun will no longer collect your data once we have recorded 1,000 miles. Once you have completed this number of miles, we anonymise 180 days after your final journey which Shotgun records.

From 25th May 2018, we will anonymise your data, at 180 days from your most recent journey or, where no journeys completed, 180 days from registration date. Data recorded prior to 25th May 2018 will be anonymised 180 days from 25th May 2018. Shotgun will no longer collect your data after the journey in which you reach 1,000 miles. Once we anonymise your data you will no longer be able to use Shotgun.

How long will you keep my Shotgun data?
Your personal data will be retained until you reach the journey in which you reach 1,000 miles. Once you have reached this level, we will no longer collect your data, and anonymise any data we do have 180 days after the completion.
What data is captured?

Your location, direction and speed among other factors. Shotgun will no longer automatically collect your data after the journey in which you reach 1,000 miles. We anonymise data after you have collected your final reward, or 180 days after your final journey which Shotgun records.

Examples of data we collect:

  • Username
  • Password
  • First name
  • Last name
  • Age
  • Driving test qualification date (month/year)
  • Phone number
Why do we collect data?
Once Shotgun’s activated, it will record and analyse data about your driving to give you feedback. We’ll use the data to understand the road type, road speed and other conditions relating to your journey. We’ll also use it to build a profile of how, where and when your car is driven.
What do we and our analytics supplier use the data for?

To help us understand driving behaviour and profile your driving style, including understanding what safe and dangerous driving looks like and the typical behaviours of different sets of drivers in the UK, as well as checking if Shotgun helps drivers drive safer.

Data will be used to help understand road and vehicle usage including for road safety issues, real time traffic flow, environmental impacts such as idle time at junctions, journey times, distances and speeds, and the analysis of junctions and the risk they represent. As well as analysing what causes, and what forces are involved in, collisions and other road incidents.

We’ll use this information to help underwrite our motor insurance policies and to help us develop similar products, services and systems.

Once you’ve completed your 1000 miles, depending on your score, you may be able to get cheaper insurance with Direct Line. What we can say for sure, we won’t use your data to increase the price of your insurance

How our partner will use Shotgun data

The information collected by the app will also be used by our analytics suppliers for research and analytical purposes both during the active period of the app and after your use of the app has ceased. Your data will be anonymised 180 days after you have completed driving the journey when you reach 1,000 miles. Any information that our analytics supplier shares with third parties will be made anonymous and will not contain any of your personal information. This will prevent data or results being directly linked to you.Our technology and analytics suppliers will use your personal data for communications that relate to your Shotgun participation.Unless you stop using the app, our analytics supplier will continue to use any ongoing data collected for the purposes below and you will be able to access your driving data for as long the app is active.

  • Road and vehicle usage including for road safety issues, real time traffic flow, environmental impacts such as idle time at junctions, journey times, distances and speeds, and the analysis of junctions and the risk they represent;
  • Driving behaviour analysis and profiling including determining what constitutes safe and dangerous driving and the typical behaviours of various segments of the UK population;
  • Analysis of the causes of, and forces involved in, collisions and other road incidents; and,
  • Researching and refining techniques for analysing motor vehicle telematics data.

4 – This bit’s about Facebook and connecting with other Shotgun users.

To make registration quicker and easier, you can register using Facebook. You’d then need to use Facebook to log in each time after.

If you choose to do this, the authentication credentials provided by Facebook will be stored on your Shotgun app and by our analytics supplier.

We have a leader board so you can see how you’re doing compared to others using Shotgun. You can also create a leader board among your friends.

By opting to use the leader board you agree to share your username, a profile picture, points earned and the miles you’ve driven with all other Shotgun users. Shotgun will no longer automatically collect your data after the journey in which you reach 1,000 miles. We anonymise your data 180 days after your final journey which Shotgun records. If you don’t opt-in your data won’t be shared. If you’re using the leader board and want to opt-out you can. Go to the more section under leader board profile.

5 – This bit’s about accessing your information

You’ll be able to see your journey data on Shotgun.

Please note:
Anyone else who may have access to your mobile phone will also be able to view the data collected by the Shotgun app.

6 – This bit’s about rewards, cancellations and complaints.

Shotgun gives you rewards for good driving. You can check how to get these in the ‘Rewards section’ in the app.

Any rewards that you qualify for at each level must be taken within 180 days of registering for the app or you may lose them. Once you have selected the reward you want, you must use this by the expiry date on the voucher.

If you want to stop taking part in Shotgun, simply delete the app from your mobile phone. If you have any questions, or if you’d like to make a complaint, please email us at shotgunrewards@directline.com.

7 – This bit’s about your use of the app.

You are responsible for ensuring that the details you provide us with are correct and complete.

You must not use the Shotgun app: (i) for fraud, crime or any unlawful activity, or (ii) to cause annoyance, inconvenience or anxiety.

We reserve the right to terminate your account without notice and at our sole discretion for breach of any applicable laws or regulations or these Terms of Use.

8 – How to contact us about this privacy notice

You may contact us at the address above for one or more of the following reasons:

  1. To ask us to fix information about you that is wrong or incomplete, or to delete personal information about you (the so-called "Right to be Forgotten").
  2. To tell us you no longer agree to, that you object to, or that you wish to restrict us using information about you and ask us to stop.
  3. A right of access, namely to ask us to provide you with a copy of all of the personal information that we have about you. To receive this information please write to the Data Rights Team, U K Insurance Limited, Churchill Court, Westmoreland Road, Bromley, BR1 1DP.
  4. A "data portability" right, namely to obtain and reuse the information that you have provided to us for your own purposes across different services. You may ask for this information to be provided directly to you or directly to another organisation. We will provide the information in a machine-readable format so that another organisation’s software can understand that information.
  5. To ask us not to use information about you in a way that allows our computer systems to make decisions about you (as explained in section 9).

Sometimes we will not be able to stop using your personal information when you ask us to (e.g. where we need to use it because the law requires us to do so or we need to retain the information for regulatory purposes).

In other cases, if we stop using your personal information, we will not be able to provide services to you, such as administering your insurance policy or servicing your claim.

We will tell you if we are unable to comply with your request, or how your request might impact you, when you contact us.

Complaints

If you have any concerns about the way in which we are using your personal information, please contact our Data Protection Officer in the first instance and we will endeavour to resolve your concern.
